In paragraph 18 of the attached FCC Order 03-284, the FCC concluded that "...wireless carriers may not impose "business rules" on their customer that purport to restrict carriers' oblications to port numbers upon receipt of a valid request to do so." Additionally, the paragraph states, "We confirmed also that, in cases where wireless carriers are unable to reach agreement regarding the terms and conditions of porting, all such carriers must port numbers upon receipt of a valid request from another carrier, with no conditions."

For any valid port request submitted to a carrier, wireline or wireless, it is the position of the LNPA WG that the length of time a customer has service with a carrier should not dictate if they can port out from that carrier.
